The Vinicius case is a potential hate crime and was thus reported by La Liga. Racist-based insults are so frequent in our society that we have got used to them and, sometimes, we don’t perceive them or give them importance. The fact that they occur in the context of games and entertainment makes them especially dangerous because they become associated with fun and are camouflaged as jokes. Racist insults are a manifestation of violence, a violation of fundamental rights, and they can’t be justified by how the person who receives them behaves.

Hate is a feeling that may or may not manifest itself. If you do it, it can cause misunderstandings, which will not be considered a crime if there is no physical aggression by one of the parties. Someone cannot be punished for the mere fact of hating.

It is an expression that is used to define reprehensible attitudes towards certain groups, including insults. Although these attitudes are considered to be serious offences by law, there are never any punitive consequences beyond a caution/warning.

Although hate is a feeling, there is also the legal concept of a "hate crime" which refers to crimes committed against people or property based on prejudices towards a group or certain people for belonging to a social group (it may have to do with age, religion, origin, sexual orientation etc.). People accused of hate crimes can be taken to court and, if found guilty, punished.

If no charges have been pressed, the police cannot initiate an investigation: it would be difficult to determine whether everything that appears on social media is real or not.

Investigating without charges being pressed is a violation of the right to privacy of both the person who recorded the video and the people who appear in it.

It is a necessary way of protecting the rights of people who, due to fear, lack of awareness, threats or other reasons, cannot press charges.

An ex officio investigation is carried out by the police when they become aware of a criminal offence (without anyone having pressed charges) and they decide to initiate an investigation. For example, this is done following videos or comments that appear on social media. First, they begin by analysing the information to ensure that it is not a fabrication and there really is a crime. Many very serious crimes (such as child pornography) are discovered through police investigations without charges first being pressed.

The Black Lives Matter movement was born in 2013 when a court acquitted the neighbourhood watchman who shot and killed Trayvon Martin, 17 years old, who was unarmed. Many people considered both the crime and the sentence to be racist, and that this racism contributes to black people in the United States suffering a greater risk of violence, as well as other violations of rights.

It is a way of talking in the media to refer to murders that are committed in wars. It is obvious that in wars there are "crimes", because the aim is to defeat the enemy by any means possible.

They refer to the terrorist acts of rebel armed groups and mercenaries. The armies of countries do not commit war crimes because they are soldiers and their profession is fighting.

They are violations of International Humanitarian Law that sometimes occur in conflicts. They can be committed by any side and are tried by an international court in the Netherlands.

In the news, when armed conflicts are reported, they sometimes talk about "war crimes". What does this refer to?

Wars also have rules, which are set out in different international laws, including the Geneva Convention. The mistreatment of prisoners, genocide, taking and executing hostages, looting, unjustified devastation, rape, torture, attacks on hospitals and schools, and the use of chemical weapons etc. are considered to be war crimes.

Social media is the best place to find independent, up-to-date and complete information on highly controversial issues, such as wars and violent acts.

We cannot trust anything at all that is said on social media: everything is a lie.

Social media can help us know what topics are current, but many people give their opinions without knowing enough or with bad intentions, and not everything that is said on social media is true.

Social media has played a positive role in mobilising society around important social causes. However, social media allows some people to manipulate information by posting hoaxes and fake news. Social media can also be an environment of violence and contribute to hate crimes. To protect our right to information, it is important to verify the news that appears on social media, learn to recognise reliable sources and distrust highly polarised messages.
